Brazil Closes Consultation on New Betting Authorization Rules

Brazil’s Secretariat of Prizes and Bets closed its public consultation on betting-operator authorization rules on 9 September 2026. The 45-day process sought contributions for a new ordinance that will replace SPA/MF Ordinance No. 827/2024, the current framework for companies seeking federal permission to offer fixed-odds betting. The consultation has ended, but no final replacement ordinance was published with the closing notice.

The consultation concerned the rules and conditions for obtaining authorization to commercially operate Brazil’s fixed-odds betting lottery modality. That regulated category covers authorized sports betting and permitted online games. It does not amount to a general legalization of every gambling product or every website that accepts Brazilian customers.

Brazil’s government opened the process on 27 July and accepted contributions from individuals and legal entities through the Brasil Participativo platform. Public Consultation Notice SPA/MF No. 3/2026 had been published in the Federal Official Gazette on 22 July. The official consultation page identifies the SPA’s General Coordination of Regulation as the responsible unit.

The SPA says its technical team will analyze the submissions and consider them while preparing the draft ordinance. The text must then complete the necessary administrative steps before publication. The closing announcement did not give a publication date, identify accepted proposals or set a transition period for existing authorization holders.

This distinction matters for operators and customers. A consultation is part of rulemaking, not the rule itself. Current authorization records and existing law remain the practical reference until a replacement measure is formally published and takes effect. Speculation about possible requirements should not be presented as a completed legal change.

The review forms part of the SPA’s regulatory agenda and follows the first authorization cycle under the federally regulated market. Secondary industry reporting says the regulator intends to use experience from that cycle when revising the administrative process. The official notices frame the review around public participation, transparency and improvement of sector regulation rather than announcing a predetermined outcome.

Authorization is the gateway between an applicant and Brazil’s legal federal market. The process must establish which legal entity is responsible, whether required corporate and technical conditions are met, and which brands and domains fall within an approval. A familiar brand name by itself is not enough because authorization belongs to a specified operator and is tied to listed domains.

Applicants and existing authorization holders should watch for the final ordinance, its effective date, transitional provisions and any updated documentary or procedural requirements. They should also distinguish a new application rule from separate obligations concerning advertising, payments, player identification, anti-money-laundering controls, responsible gambling and approved game content.

Businesses preparing an application should keep ownership, legal-entity, technical, financial and compliance records current rather than waiting for the final text. However, the exact evidence and deadlines must come from the published ordinance. The consultation announcement does not support assuming that an application will be approved, renewed or rejected.

Brazilian players should verify the operator and exact domain against the Ministry of Finance’s current authorization records. Federally authorized betting sites use the .bet.br domain, but the suffix should be checked together with the listed company and brand. A lookalike address, advertisement, payment request or social-media account does not become legitimate merely by copying the name of an authorized operator.

Before depositing, confirm that the address bar shows the exact approved domain, read the local terms, check age and identity requirements, and use only payment routes presented inside the official account. Do not send money to an individual or pay a private “release fee” to unlock a withdrawal. Keep transaction and support records if a dispute arises.

The number and substance of public submissions, the SPA’s response to them and the wording of the final authorization rules were not included in the closing notice. Until those materials are released, claims about new fees, approval standards, deadlines or market restrictions remain unconfirmed unless supported by another enacted measure.

The next decisive event is publication of the replacement ordinance. Operators will then need to compare it with SPA/MF Ordinance No. 827/2024 and identify which provisions change, when they apply and whether current authorizations receive transitional treatment. Players should continue to rely on live government records rather than treating the consultation deadline as a licence change.
